Terms & Conditions

We will do whatever we can to make your stay as enjoyable and relaxing as possible. We only ask that you and your guests abide by these standard terms and conditions and respect the Villa and our staff. If you have any concerns or questions, please feel free to ask about it and we can make adjustments that suit both parties as long as they are agreed in advance.

BOOKINGS Bookings are on a 'first-come, first-served' basis and are for a minimum of three (3) nights green and high season, 7 days in peak season. Baan Ping Thara reserves the right to decline a booking without providing explanation. A booking will be held confirmed once the full payment has been paid and the terms and conditions have been acknowledged.

ARRIVAL & DEPARTURE TIMES The check-in time is after 1pm, and check-out time is prior to 11am, unless otherwise agreed.

REGISTERED GUESTS The number of people staying at the property must not exceed four people plus one infant (under two years old), unless agreed in advance. Should Baan Ping Thara find that the number of people staying at the property exceeds this, we may, at the discretion of Baan Ping Thara, ask the extra person or persons to vacate the property forthwith. Deduction from the security deposit for overnight guests above this limit can be claimed at 1,000 Thai Baht per night per person.

If you have Guests at the Villa for services such as massage, private chefs, caterers or any other third party, they are the responsibility of the signed Guests and bound by these terms and conditions. Any damage or theft of property by these third parties will be the sole responsibility of the Guests.

PETS No pets are allowed on the entire property.

SMOKING This is a non-smoking Villa. If Guests wish to smoke they do so outdoors where the swimming pool is located.

PAYMENT A full payment is due at the time of booking the villa. There is a 7-day minimum stay requirement during the Peak Season (Dec 14, 2015 - Jan 17, 2016). There is a 3 day minimum stay requirement during remainder of the year.

SECURITY DEPOSIT A security deposit (US$ 100 or 3,500 Thai Baht) is payable with the final payment due before check or in alternative in cash during check in. This is to cover the cost of any damage or breakages of the Villa or contents during the rental period. The security deposit will be promptly returned on check out after a brief check of the Villa, providing that there are no items missing or damages found.

DAMAGE AND BREAKAGE Damages to the property, or any contents will be charged at a rate to repair the damage to at least equal to the original condition. A sheet of item charges can be requested at check-in. Baan Ping Thara is a non-smoking villa. If persons are found to be smoking inside the Villa, then Baan Ping Thara has the right to have any bedding, curtains, floor covering or other soft furnishings dry cleaned at the expense of the Guest. Any burns or marks which may require more extensive repairs and/or furniture being recovered, will be the responsibility of the Guest. Breakages will be charged at the cost of the item plus any travel or shipping costs to replace the broken item.

MISSING ITEMS Any missing items for the Villa will be charged at replacement value. This includes, but is not limited to, towels, bedding, robes, slippers, silks, artwork, umbrellas, electronics equipment, furniture, appliances, kitchen equipment, silverware, toiletries.

CANCELLATION Cancellations will be charged 25% of the total booking. Cancellations within 14 days of check in will be charged 100%.

LESSEE'S INSURANCE Each guest is encouraged to have comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage). Liability insurance is also recommended. Baan Ping Thara is held harmless by you and your party against all claims including any accidents related to the use of the Villa, pool, scooters and vehicles or locally procured third party services such as, but not limited to, watercraft, water sports, tours, transportation, attractions, jeep or motorbike rental. 

FORCE MAJEURE Lessor shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside of Lessor's control such as civil disturbances, fires, floods, severe weather, Acts of God, and any occurrences outside the control of the Lessor.

COMPLAINTS Lessor cannot be held liable for interruptions of the supply of water, or electricity, or Internet connection or breakdown of swimming pool filtration systems, though Lessor will use our best endeavours to arrange for any such problems to be solved quickly. It is understood that infrastructure, local standards and conditions are often of a less developed nature in a remote resort location than in more urban environments. Lessor or its representative will do as much as can be reasonably expected to avoid and rectify. Any complaints should be made in writing to the Lessor within 24 hours of the occurrence. If the Villa is vacated before the end of the rental period without mutual agreement, this will result in the loss of all rights to compensation.

CONDUCT & BEHAVIOUR Lessor is responsible for the correct and appropriate behaviour of the Guests staying at the Villa. Should any member of the party behave in a manner considered inappropriate, either the Lessor or the local representative may at their absolute discretion ask the offending guest or Guests to vacate the Villa forthwith. No refund can be claimed from the Lessor in such case. Owner or his representative may enter the Villa at any time to investigate suspected infractions of this agreement.

FOOD AND BEVERAGE All food and beverage items purchased on behalf of guests will be charged to guests at cost +15%, with a minimum charge of 150 Thai Baht. This charge is to cover condiments, cooking gas and transportation and all costs incurred from cooking and kitchen related expenses.

LINEN & TOWELS Linen and towels are provided at the Villa. These are normally changed every three (3) days or as deemed necessary.

TRANSFERS Rates do not include airport pickup and return. Airport pick-up and drop-off can be provided on request for 700 baht for up to 4 people per trip. Transport can also be arranged to Krabi town bus station or a number of piers operating in the area. Inquire directly for rates.

VALUABLES A personal safe is provided in both bedrooms. It is strongly recommended that it be used to store valuable items such as passports, cash, traveller's checks, jewellery, mobile phone, cameras, etc. Any valuables left at the property are the guests' sole responsibility and neither the Lessor nor the staff can be held responsible for any loss or damage of personal property.

DUE CARE AND SUPERVISION/INDEMNITY Lessee accepts and acknowledges that they are responsible and liable for the safety and well-being of all guests and third parties staying at the Villa during the time of the rental. Lessee and their guests are required to take due care when residing at the villa and be especially watchful of children playing in the gardens, near or in the pool. Children MUST be under supervision of an adult at all times when staying at the Villa. Guests are not permitted to enter the Villa when wet from swimming, as the floors can be slippery. Damage or injury arising as a result shall not be the responsibility of Lessor. Showering before using the pool is required as the cost of replacing/cleaning water containing sun creams, oils and lotions can be significant. The Lessee can be responsible for a 5000 baht cleaning fee if such pollutants or drinks, food, waste, refuse, etc. enter the pool, intentionally or otherwise. 

APPLICABLE LAW These conditions and any contract to which they apply are governed in all respects by Thai law and the Thai courts only shall have jurisdiction in relation to any claim or dispute arising out of, or connected with them.

AGREEMENT By entering into a rental agreement with Baan Ping Thara guests are deemed to have accepted these terms and conditions.
